Creates the STAR Bonds Financing Act. Contains only a short title provision.

Senate Floor Amendment No. 1
Adds reference to:
65 ILCS 5/8-4-1from Ch. 24, par. 8-4-1

Deletes everything after the enacting clause. Creates the STAR Bonds Financing Act. Authorizes certain municipalities and counties to issue sales tax and revenue (STAR) bonds for the financing of a STAR bond project. Defines "STAR bond project". Grants certain powers to municipalities and counties, including the power to exercise the use of eminent domain and the power to issue bonds. Specifies eligibility requirements for STAR bond projects. Makes other changes. Amends the Illinois Municipal Code. Provides that the corporate authorities of a municipality may authorize the issuance of STAR bonds without submitting the question of issuing the bonds to the electors of the municipality. Effective immediately.

 SB 1909, as engrossed, would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence.

 Fiscal Note (Dept. of Revenue)
 SB 1909, as engrossed, would have a negative impact on State government revenue from the Retailers' Occupation Tax, Use Tax, Service Occupation Tax, Electricity Excise Tax, Gas Revenue Tax, and Hotel Operators' Occupation Tax. The combined annual loss to these revenue sources could exceed $15 million annually per established district given the terms of the proposal and depending on the location of the district. Much of this loss will be due to the erosion of the State government tax base that existed before the STAR district was created.

 Balanced Budget Note (Office of Management and Budget)
 SB 1909, as engrossed, would cost the State $15,000,000 in lost sales tax revenue as estimated by the Department of Revenue. SB 1909, if enacted into law would add $15,000,000 in additional spending pressure to the General Revenue Fund and to the current Fiscal Year 2009 budget deficit.

 Based on a review of the bill, it has been determined that SB 1909 (H-AM 2) would neither increase nor decrease the number of judges needed in the State.

Deletes everything after the enacting clause. Creates the STAR Bonds Financing Act. Authorizes municipalities and counties to issue sales tax and revenue (STAR) bonds for the financing of a STAR bond project. Grants certain powers to municipalities and counties, including the power to exercise the use of eminent domain and the power to issue bonds. Sets forth eligibility requirements for STAR bond projects. Provides that the Department of Revenue shall not collect or allocate any local sales tax increment or State sales tax increment until the municipality or county satisfies certain requirements. Sets forth the requirements. Specifies the procedure for the transfer of local sales tax increment into the STAR Bonds Revenue Fund. Makes conforming changes in the Counties Code, the Illinois Municipal Code, the Metropolitan Pier and Exposition Authority Act, the Regional Transportation Authority Act, the Metro-East Park and Recreation District Act, the Local Mass Transit District Act, the Flood Prevention District Act, and the Water Commission Act of 1985. Amends the State Finance Act to create the STAR Bonds Revenue Fund. Contains other provisions. Effective immediately.

Recommends, in provisions listing revenues from which STAR bonds may be made payable, making the bonds payable from up to 50% of the State sales tax increment, but not to exceed 50% of the total project costs (rather than from all of the State sales tax increment).
