Synopsis As Introduced
Amends the Crime Victims Compensation Act. Makes a technical change in a Section concerning the short title.

Senate Floor Amendment No. 1
Deletes reference to:
740 ILCS 45/1
Adds reference to:
760 ILCS 5/5.4 new

Deletes everything after the enacting clause. Amends the Trusts and Trustees Act. Provides that a spendthrift trust is created by a settlor who irrevocably transfers property to a trust having at least one State-authorized corporate trustee that provides the income to the settlor as a beneficiary. Provides that neither the principal nor the income of a spendthrift trust may be voluntarily or involuntarily transferred before payment to the settlor as a beneficiary. Provides that the corporate trustee shall materially participate in the trust. Provides that a creditor of the settlor may not satisfy a claim out of a spendthrift trust or the settlor's beneficial interest in that trust. Provides that a spendthrift trust does not prevent a creditor from satisfying a claim out of the trust if: the claim is a judgment or enforceable decision rendered in a judicial, arbitration, or administrative proceeding that was commenced before or within 3 years after the trust is created; the settlor's transfer intentionally defrauded the claimant; the trust allows the settlor to revoke all or part of the trust; the claim is to collect child support, maintenance, marital property, public assistance, or a debt owed to a government; the settlor was insolvent or the transfer rendered the settlor insolvent; and other circumstances. Provides a statute of limitations. Provides that a spendthrift trust is not revoked or terminated by: a power to veto a trust distribution, the right to receive a discretionary distribution determined by another person, and other specified conditions. Provides other details. Provides that the Illinois courts have exclusive jurisdiction over any action concerning these provisions. Makes other changes.

 SB 1066 (H-AM 7) will impact the timing for savings, estimated annually at $4-5 million in medical costs and $5-6 million in utilization review. In any given fiscal year, 30% to 35% of paid medical costs are due to accidents occurring within that fiscal year. As in this amendment phases in reforms for accidents after the date of passage, except for medical cost savings, projected savings for medical costs will remain at $4-$5 million, but savings for utilization review and doctor choice will be reduced to $1.7 to $2 million in the first year. Full annual savings would be realized in late FY13 to early FY14.
