Synopsis As Introduced
Amends the Criminal Code of 1961. Provides that the exemption from violations of the unlawful use of a weapon statutes for carrying firearms applies to portable containers designed for the safe transportation of firearms (rather than any container). Effective immediately.

Adds reference to:
720 ILCS 5/24-3from Ch. 38, par. 24-3

Further amends the Criminal Code of 1961. In the exemption from a violation of the statutes concerning unlawful use of weapons and aggravated unlawful use of a weapon, provides that the transportation of the weapon must be unloaded and enclosed in a firearm case, carrying box, shipping box, or a similar portable (rather than any portable) container designed for the safe transportation of firearms. Provides that it is a Class 1 felony to sell or give a firearm to a person whom the seller or giver knows is a street gang member.

 State Debt Impact Note (Government Forecasting & Accountability)
 HB 5849 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 HB 5849 would neither increase nor decrease the number of judges needed in the State.

 HB 5849 will have no fiscal impact on any pension funds or retirement systems in Illinois.
