Synopsis As Introduced
Amends the Firearm Owners Identification Card Act. Provides that a person who is not a federally licensed importer, manufacturer, or dealer and who desires to sell or transfer a firearm of a size that may be concealed upon the person to another person, who is not a federally licensed importer, manufacturer, or dealer, shall do so only at the place of business of a federally licensed firearm dealer. Provides that the federally licensed firearm dealer shall conduct a background check on the prospective recipient of the firearm and follow all other applicable federal, State, and local laws as if he or she were the seller of the firearm. Provides that the purchaser or transferee may be required by the federally licensed firearm dealer to pay a fee not to exceed $10 per firearm, plus other authorized fees. Makes exceptions for (i) the transfer of a firearm between spouses, a parent and child, or other family members, (ii) transfers by persons acting pursuant to operation of law or a court order, or (iii) transfers on the grounds of a gun show.

Further amends the Firearm Owners Identification Act. Provides that the Department of State Police shall develop an Internet based system for individuals to request the Department of State Police to conduct an instant criminal background check prior to the sale or transfer of a handgun. Provides that the system shall be completed and available by July 1, 2012.

 Fiscal Note, House Floor Amendment No. 1 (Illinois State Police)
 It is difficult to estimate how many private transactions would be conducted, but the Illinois State Rifle Association (ISRA) provided the estimate of 260,000 transactions. The Firearm Transfer Inquiry Program (FTIP) would see a significant increase in the number of transactions needing to be processed. It is believed additional personnel and IT resources would be needed to avoid processing delays. It is not unreasonable to estimate start-up and out year costs to exceed $250,000 based on the ISRA estimate. The preliminary estimates include: (1) 4 Office Associates (@$60,000) = $240,000; (2) 5 Computers (@ $1,500) = $7,500; (3) 5 FTIP phones (@$1,000) = $5,000; (4) 1 Supervisor = $80,000; (5) System Modifications = $50,000; Total = $382,500. The amendment requiring an Internet based system be in place by 2012 will require funding in advance. $2 million in FY11 and $1.5 million in FY12 will be needed, but has not yet been identified.

 Housing Affordability Impact Note, House Floor Amendment No. 1 (Housing Development Authority)
 This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence.

 Balanced Budget Note, House Floor Amendment No. 1 (Office of Management and Budget)
 The initial cost associated with HB 5480 (House Amend. 1) is $382,500. This estimate does not include additional implementation costs that cannot be identified at this time. Additionally, no funding source is identified in the legislation, so it is reasonable to assume any associated implementation costs would be absorbed by the General Revenue Fund.
