Synopsis As Introduced
Creates the Veterans Court Act. Contains only a short title Section.

House Committee Amendment No. 1
Adds reference to:
New Act
55 ILCS 5/5-1101from Ch. 34, par. 5-1101

Creates the Veterans and Servicemembers Court Treatment Act. Provides that the Chief Judge of each judicial circuit may establish a Veterans and Servicemembers Court program including a format under which it operates under the Act. Provides that the Veterans and Servicemembers Court may, at the discretion of the Chief Judge, be a separate court or a program of a drug court within the Circuit. Provides that at the discretion of the Chief Judge, the Veterans and Servicemembers Court program may be operated in one county in the Circuit, and allow veteran and servicemember defendants from all counties within the Circuit to participate. Provides that a defendant may be admitted into a Veterans and Servicemembers Court program only upon the agreement of the prosecutor and the defendant and with the approval of the Court. Establishes conditions in which veterans and servicemembers are eligible for the program. Provides for substance abuse treatment of eligible members. Amends the Counties Code. Provides that a $10 fee shall be paid by the defendant on a judgment of guilty or a grant of supervision to be placed in the county general fund and used to finance the Veterans and Servicemembers Court. Effective immediately.

 While this bill may increase the number of judges needed in the State, it is not possible to determine the number of additional judges needed.

 Balanced Budget Note, House Committee Amendment No. 1 (Office of Management and Budget)
 HB 5214 will have no impact on the General Revenue Fund. Veterans or Servicemembers who are referred to State-funded services would already be eligible for such services.
