Synopsis As Introduced Amends the Animal Control Act. Provides that the owner or keeper of a dog is liable to a person for all damages caused by the dog pursuing, chasing, worrying, wounding, injuring, or killing any sheep, goats, cattle, horses, mules, poultry, ratites, swine, or companion animals (now, there is no liability for damages caused to companion animals). Defines "companion animal" as a dog or cat that is treated as a pet. Effective immediately.
House Floor Amendment No. 1 Deletes everything after the enacting clause. Amends the Animal Control Act. Reinserts the provisions of the introduced bill with the following changes. Removes a provision that provides that the owner or keeper of a dog is liable for all damages caused by the dog "worrying" specified animals. Provides that the dog's owner or keeper may raise as an affirmative defense (i) the negligence of the person who owns or is responsible for the injured animal or (ii) the provocation of the dog by the injured animal. Effective immediately.
