Synopsis As Introduced
Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. In connection with the pharmaceutical assistance program under the Act, provides that to become a beneficiary under the program, a person must have a maximum household income equal to or less than 239% of the Federal Poverty Level (instead of less than specified amounts or equal to or less than 200% of the Federal Poverty Level). Provides for 4 (instead of 5) Eligibility Groups (eliminates current Eligibility Group 3). For persons in the Eligibility Group consisting of persons who have a diagnosis of HIV or AIDS, provides for an alternative co-payment according to whether or not a drug is covered by the Medicare Part D Prescription Drug Plan in which the beneficiary is enrolled (in addition to whether or not the drug is included in the formulary of the Illinois AIDS Drug Assistance Program operated by the Illinois Department of Public Health). Makes changes in the definitions of "covered prescription drug" for each Eligibility Group. Makes other changes. Effective immediately.

Replaces everything after the enacting clause. Amends the Mobile Home Local Services Tax Act to change a reference from the Department of Revenue to the Department on Aging in connection with applications filed under the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. Amends the Citizens Utility Board Act to delete a reference to the Department of Revenue in connection with mailings made under the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. Provides that common references to the "Circuit Breaker Act" mean the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. Makes changes to implement Executive Order No. 3 of 2004, which transferred administration of the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act from the Department of Revenue to the Department on Aging and the Department of Healthcare and Family Services. Makes other changes with respect to definitions, applications for benefits, income eligibility limitations, appeals of denials of claims, recovery of amounts paid on account of an erroneous or fraudulent claim, regulations, and other matters. Effective January 1, 2010.

House Floor Amendment No. 3
Replaces everything after the enacting clause with substantially similar provisions, amending the Mobile Home Local Services Tax Act, the Citizens Utility Board Act, and the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act, except provides that for purposes of both the property tax relief grant program and the pharmaceutical assistance program, the specified household income eligibility limits may (instead of shall) be changed to reflect annual cost of living adjustments in Social Security and Supplemental Security Income benefits. Effective January 1, 2010.

Governor Amendatory Veto Message
Recommends the following changes: that specified benefits be made subject to appropriation; that specified income eligibility limitations be replaced with requirements that for 2011 claim year applications submitted during calendar year 2012, and claim years thereafter, a household must have annual household income of less than the applicable limit for its size, calculated to reflect the annual cost of living adjustment in Social Security and Supplemental Security Income benefits that are applicable to the year for which those benefits are being reported as income on an application in each intervening year for the 2006 through 2011 calendar years, keeping the limit commensurate with the Pharmaceutical Assistance Program; that rules may be adopted so that on January 1, 2013 (rather than 2011) and thereafter, certain household income eligibility limits may be changed to reflect the annual cost of living adjustment in Social Security and Supplemental Security Income benefits that are applicable to the year for which those benefits are being reported as income on an application; that specified income eligibility limitations for the Illinois Seniors and Disabled Drug Coverage Program be replaced with requirements that for the 2007 claim year through the 2010 claim year, a person must have a maximum household income of less than $22,218 for a household containing one person, $29,480 for a household containing 2 persons, or $36,740 for a household containing 3 or more persons and for 2011 claim year applications submitted during calendar year 2012, and claim years thereafter, a household must have an annual household income of less than the applicable limit for its size, as calculated to reflect the annual cost of living adjustment in Social Security and Supplemental Security Income benefits that is applicable to the year for which those benefits are being reported as income on an application in each intervening year for the 2006 through 2011 calendar years; and that the changes made by the amendatory Act with respect to eligibility groups and pharmaceutical benefits in the Illinois Seniors and Disabled Drug Coverage Program take effect on January 1, 2012.
