Synopsis As Introduced
Amends the Illinois Highway Code. Provides that the Department of Transportation shall, upon application, erect and maintain roadside markers to identify the locations where persons were killed in accidents involving drunken drivers. Establishes requirements for the application for placement of the markers and for the markers themselves. Provides that, if the new provision conflicts with federal law, the markers shall not be erected or maintained. Provides that the Department shall prepare an evaluation of the program authorized by the new provision and shall report its findings to the General Assembly by January 1, 2008. Effective immediately.

	Adds reference to:
	New Act

Deletes everything after the enacting clause. Creates the Illinois Roadside Memorial Act. Provides for the placement of roadside markers to commemorate the deaths of persons killed in accidents involving impaired drivers. Provides that the purpose of the new Act is to raise public awareness of impaired driving by emphasizing the dangers while affording families an opportunity to remember the victims. Provides that a qualified relative of the victim shall apply to a sponsoring jurisdiction for placement of the marker. Provides that the sponsoring jurisdiction shall have sole responsibility for determining whether the request is accepted. Sets additional requirements for placement of the markers. Provides that the sponsoring jurisdiction has the right to install the marker at a location other than the location of the crash. Effective January 1, 2008.

	Passage of this legislation will cause no fiscal impact to the Illinois Department of Transportation.

House Floor Amendment No. 2
Provides that the Act may be referred to as Tina's Law. Provides that a qualified relative of a victim may make a request for the installation of a memorial marker in a supporting jurisdiction using an application developed by the supporting jurisdiction. Provides that the same marker may be used to memorialize more than one DUI crash death.
