Synopsis As Introduced
Creates the Identity Document Protection Act. Provides that no identity document created, mandated, or issued by the State, a unit of local government, or a school district may contain a contactless integrated circuit that can broadcast personal information or enable personal information to be scanned remotely. Exempts the Toll Highway Authority I-Pass system. Limits the concurrent exercise of home rule powers. Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a retailer may not offer for sale or sell any article that has a contactless integrated circuit attached to it without notifying the consumer and affording the consumer the opportunity to have the circuit removed at no charge to the consumer.

Senate Committee Amendment No. 2
Deletes everything after the enacting clause, and reinserts the provisions of the introduced bill. Makes changes to exclude identification badges issued to certain State and local government employees and identification documents issued to inmates by the Department of Corrections. Allows retailers to offer for sale a device that contains a contactless integrated circuit if the device is marketed, offered for sale, and sold to consumers as a device with contactless integrated circuit technology to be used by the consumer.

Senate Floor Amendment No. 3

	Deletes reference to:
	815 ILCS 505/2XX new

Deletes everything after the enacting clause. Reinserts the provisions of Senate Amendment 2 with changes. Creates additional exceptions to the Act for identification badges issued to State or unit of local government law enforcement, fire protection, and other public safety personnel, identification documents issued to incarcerated persons or persons who are under probation, parole, or mandatory supervised release, certain global positioning system receivers, security access cards issued by the State or a unit of local government, public transportation passes, and library cards. Provides that allowed uses of contactless integrated circuits must be for their commonly understood and expressly identified purpose, except for certain law enforcement use. Deletes the changes to the Consumer Fraud and Deceptive Business Practices Act.
