Synopsis As Introduced
Amends the Illinois Act on the Aging. Provides that regional long term care ombudsman programs may use trained volunteers to make routine visits to facilities licensed or certified under the Nursing Home Care Act, the Assisted Living and Shared Housing Act, and the Social Security Act or to any other facility for which long term care ombudsmen are obligated to visit either by federal or State law. Sets forth requirements for the volunteers. Amends the Health Care Worker Background Check Act. Includes a trained-volunteer program operated by a regional long term care ombudsman program within the definition of "health care employer". Effective immediately.

Senate Committee Amendment No. 1
In the Illinois Act on the Aging, provides that volunteers in a regional long term care ombudsman program may not investigate or resolve complaints related to abuse and neglect. Defines "abuse" and "neglect". In the Health Care Worker Background Check Act, specifies that regional long term care ombudsman programs are "health care employers" only for the purpose of securing background checks on all paid and volunteer ombudsmen. Effective immediately.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Reinserts the provisions of the bill as introduced with the following changes: In the Illinois Act on the Aging, deletes a provision permitting regional long term care ombudsman programs to use volunteers to visit certain facilities. Requires ombudsmen (instead of volunteers) to submit to a background check and receive certain training. In the Health Care Worker Background Check Act, provides that the State Long Term Care Ombudsman Program, including any regional long term care ombudsman programs is a "health care employer" only for the purpose of securing background checks. Changes the effective date from an immediate effective date to January 1, 2005.
