Illinois General Assembly - Bill Status for SB2287

Deletes everything after the enacting clause. Amends the Circuit Courts Act. Provides that the number of associate judges in the 19th circuit on and after December 4, 2006 shall be no less than the number of associate judges residing in Lake County on March 22, 2004. Requires that an associate judge of a circuit reside in the circuit and continue to reside in that subcircuit as long as he or she holds that office. Provides that this residency requirement shall not apply to persons serving as associate judges on the effective date of this amendatory Act of the 93rd General Assembly. Provides that, on and after December 4, 2006 in the 19th circuit, associate judgeships shall be allocated equally among the subcircuits. Provides that, if, after associate judgeships are allocated equally among the subcircuits, there are any remaining associate judgeships that have not been allocated to a subcircuit, those associate judgeships shall be filled at large from the entire circuit.

Further amends the Circuit Courts Act and the Associate Judges Act. In the 12th judicial circuit (Will County), removes the conversion of 2 associate judgeships into residential subcircuit judgeships required by Public Act 93-541. Creates 2 additional resident judgeships for allotment as subcircuit judgeships. Effective immediately.

Removes the February 1, 2004 deadline for the General Assembly to create subcircuits within the 12th (Will County), 19th (Lake County), and 22nd (McHenry County) judicial circuits. In the 12th judicial circuit (Will County), removes the conversion of 2 associate judgeships to resident subcircuit judgeships required by Public Act 93-541; creates 2 additional resident judgeships in that circuit for allotment as subcircuit judgeships. Provides that the 2 resident judgeships in the 12th judicial circuit created by this bill shall be filled beginning at the general election in 2008. Permits the additional resident judgeships created by Public Act 93-541 and this bill to be filled by appointment by the Supreme Court before election (rather than requiring the Supreme Court to fill the one additional resident judgeship created by Public Act 93-541 before the 2006 general election). Provides that on and after December 4, 2006, the minimum number of associate judges authorized for the 19th judicial circuit (Lake County) shall be 20 (rather than 14). Provides that when the Supreme Court on December 4, 2006 allocates associate judges between the 19th and 22nd circuits as required by Public Act 93-541, the allocation must be based on residency of the associate judges (rather than based on population of the circuits) and the 19th circuit must be allocated no fewer associate judges than resided in Lake County on March 22, 2004. Effective immediately.
