Illinois General Assembly - Bill Status for SB2188

Creates the Retired Officers Security Act. Permits the Department of State Police to issue permits to carry concealed firearms to retired peace officers and retired military who have served honorably for at least 10 years. Provides that permits to carry a concealed firearm shall be valid throughout the State for a period of 4 years from the date of issuance. Provides that a person in compliance with the terms of the permit may carry concealed firearms on or about his or her person. Provides that the permittee shall carry the permit at all times the permittee is carrying a concealed firearm and shall display the permit upon the request of a law enforcement officer. Establishes firearm proficiency tests for applicants for concealed carry permits. Repeals the Act on January 1, 2010. Amends the Firearm Owners Identification Card Act. Pre-empts home rule regulation of the issuance of concealed carry permits. Effective immediately.

Deletes all. Reinserts the provisions of the bill as introduced but provides that a permit to carry a concealed firearms rather than being issued to a retired Armed Forces member may be issued to a person who earned the Military Occupation Specialty of a military police officer, investigator, or its equivalent in any of the Armed Forces and who served for at least 10 years as a member of the United States Armed Forces whose service was honorably terminated and not as a result of discipline, suspension, or discharge. Provides that the Department of State Police may (rather than shall) provide a written list of names of persons licensed to carry concealed firearms. Amends the Criminal Code of 1961. Exempts from the unlawful use of weapons statute, any person issued a permit to carry a concealed firearm. Effective immediately.

Deletes everything after the enacting clause. Reinserts the provisions of Senate Amendment No. 1 with the following changes: Provides that a permit to carry a concealed firearm is valid for a period of 5 years after issuance. Provides that a renewal fee for a permit is $100. Provides that an applicant for a permit must be a United States citizen or a naturalized citizen. Provides that the Department of State Police shall notify the permittee not later than 60 days before expiration of the permit of the expiration and shall furnish a renewal application. Provides that the Act is repealed on July 1, 2010. Makes other changes. Effective January 1, 2005.

Deletes everything after the enacting clause. Amends the Firearm Owners Identification Card Act. Provides that if the receipt of a firearm does not violate federal or State law, the Department of State Police shall (1) assign a unique number to the transfer; (2) provide the licensee with the number; and (3) destroy all records of the system with respect to the call, other than the identifying number and the date the number was assigned, and all records of the system relating to the transfer within 24 hours. Provides that the Department of State Police may not retain, copy, or distribute any such information previously collected. Provides that if the transfer of a firearm is denied by the Department of State Police, the Department may keep the records of a denial until the denial is appealed and overturned, or as long as necessary for a criminal prosecution. Provides that approvals issued by the Department of State Police for the purchase of a firearm are valid for 30 days from the date of issue.
