Illinois General Assembly - Bill Status for HB7015

Deletes everything. Amends the Illinois Vehicle Code. Amends the provision providing for special speed limits while passing schools or while traveling through highway construction or maintenance zones by making it apply only while passing schools. Creates a new provision providing for special speed limits while traveling through construction or maintenance zones. The new provision contains language similar to that of the previous provision with regard to construction or maintenance zones. Provides that a first violation is a petty offense with a minimum fine of $375. Provides that a second or subsequent violation carries a minimum fine of $750. Further provides that if a police officer determines that a person violated the provision by traveling through a construction or maintenance zone at a speed 20 miles per hour or more in excess of the posted speed limit, the officer may immediately arrest the person, take him or her into custody, and cause the removal of the vehicle. Provides that a person who exceeds the speed limit in a construction or maintenance zone by 20 miles per hour or more commits a Class A misdemeanor. Provides for an automated construction or maintenance speed zone enforcement system. Provides for adjudication of violations recorded by photograph or other recorded image. Provides for fines and other charges similar to those for a violation of the construction or maintenance speed zone provision, except that a person whose offense is recorded by the automated system may not be found guilty of a Class A misdemeanor. Provides that, for a second or subsequent violation of a construction or maintenance zone speed limit, the Secretary of State shall suspend the driver's license of the violator for a period of not less than 90 days. Provides that the parts of the new automated enforcement provision are severable. Effective immediately.

Provides that the minimum fine for a first violation of a highway construction or maintenance zone speed limit is $250 (rather than $375). Provides that the Secretary shall suspend a person's license for 90 days for a second or subsequent violation within 2 years of the previous violation (rather than suspending the license for not less than 90 days for any second or subsequent violation). Deletes all language providing for an automated construction or maintenance speed zone enforcement system.
