Illinois General Assembly - Bill Status for HB5094

Amends the Environmental Protection Act. Provides that the construction of any equipment, facility, vehicle, vessel, or aircraft capable of causing or contributing to air pollution or designed to prevent air pollution does not require a construction permit unless that equipment, facility, vehicle, vessel, or aircraft is subject to regulation under certain Sections of the federal Clean Air Act. Provides that the construction of any equipment, facility, vehicle, vessel, or aircraft capable of causing or contributing to water pollution or designed to prevent water pollution does not require a construction or operation permit unless (i) the construction of the equipment, facility, vehicle, vessel, or aircraft will be funded in whole or in part by financial support from the State or the federal government or (ii) the equipment, facility, vehicle, vessel, or aircraft is for the purpose of the pretreatment of wastewater prior to discharge to a non-delegated publicly owned treatment works. Sets forth procedures by which the Environmental Protection Agency must: (i) allow a permit applicant to review and comment on a proposed draft permit; (ii) issue general permits that do not require individual applications for categories of similar sources or equipment, facilities, vessels, or aircraft; (iii) allow a permit applicant to select a permitting analyst to perform permit application reviews and drafting on behalf of the Agency; and (iv) provide, upon an applicant's request, an expedited review of a permit application. Effective immediately.

Deletes everything after the enacting clause. Amends the Environmental Protection Act. Includes additional materials within the definition of "coal combustion by-product" (CCB). Provides that, in certain circumstances, the EPA must (instead of "may") make written beneficial use determinations that coal-combustion waste is a CCB. Sets forth the procedures for the application for and approval of a beneficial use. Requires the Pollution Control Board to examine and streamline its air pollution control permit requirements, with the objective of creating additional permit exemptions and eliminating permit requirements for insignificant activities and emission units. Sets forth requirements for streamlining the permit requirements. Provides that the owner or operator of a CAAPP source is not required to obtain an air pollution control construction permit for the construction or modification of an insignificant emission unit or activity. Creates the Environmental Protection Foundation as a not-for-profit corporation. Sets forth procedures for the appointment of the Board of Directors and for the operation of the Foundation. Sets forth the purposes of the Foundation.

Deletes everything. Amends the Environmental Protection Act. Makes a technical change in a Section concerning agrichemical facility or lawncare containment permit endorsement.

Further amends the Environmental Protection Act. Provides that, except in Cook County, "clean construction or demolition debris" includes uncontaminated broken concrete with metal bars that do not protrude more than 2 feet. Provides that the provisions changing the Section of the Environmental Protection Act defining "clean construction or demolition debris" are effective immediately.
