Statutes Amended In Order of Appearance

Synopsis As Introduced
Amends the Code of Civil Procedure to prohibit court orders and judgments from concealing public hazards. Effective July 1, 2003, and applies to causes of action accruing on or after that date.

House Committee Amendment No. 1
Provides that the provisions of the bill do not apply to health care professionals or providers.

 Judicial Note (H-AM 1) (Admin Office of the Illinois Courts)
 House Bill 1191, as amended by House Amendment No. 1, would result in some increase in judicial workloads, however, it is not anticipated that the bill would increase the number of judges needed in the state.

 Fiscal Note (H-AM 1) (Department of Professional Regulation)
 HB 1191 (House Amendment 1) will have no fiscal impact on the agency.

 State Mandates Fiscal Note (H-AM 1) (Dept of Commerce and Community Affairs)
 Under the State Mandates Act, a "State mandate" means any State-initiated statutory or executive action that requires a unit of local government to establish, expand, or modify its activities in such a way as to necessitate additional expenditures from local revenues. The provisions of HB 1191 (HA #1) do not require the additional expenditure of local government funds. Therefore, in the opinion of DCCA, HB 1191 (HA #1) does not meet the definition of a State Mandate under the State Mandates Act.

House Floor Amendment No. 3
Deletes everything. Inserts the contents of the bill as introduced, except deletes the reference to "a person" in the definition of "public hazard". Effective July 1, 2003.
