Replaces everything after the enacting clause. Creates the Cancer Drug Repository Program Act. Provides that the Department of Public Health shall establish and maintain a cancer drug repository program, under which any person may donate a cancer drug or supplies needed to administer a cancer drug for use by an individual who meets eligibility criteria specified by the Department in rules. Sets forth the requirements for accepting cancer drugs and supplies for the Program. Provides that no cancer drug or supplies needed to administer a cancer drug that are donated for use under the Act may be resold. Provides that nothing in the Act requires that a pharmacy or pharmacist participate in the cancer drug repository program. Provides that unless a manufacturer's conduct is wilful and wanton, a manufacturer of a drug or supply is not subject to criminal or civil liability for injury, death, or loss to a person or property for matters related to the donation, acceptance, or dispensing of a cancer drug or supply manufactured by the manufacturer that is donated by any person under the Act. Provides that unless the person's conduct is wilful and wanton, a person is immune from civil liability for injury to or the death of the individual to whom the cancer drug or supply is dispensed and may not be found guilty of unprofessional conduct for his or her acts or omissions related to donating, accepting, distributing, or dispensing a cancer drug or supply under the Act. Requires the Department to adopt certain rules to implement the cancer drug repository program. Amends the Pharmacy Practice Act of 1987, the Wholesale Drug Distribution Licensing Act, the Senior Pharmaceutical Assistance Act, the Illinois Food, Drug and Cosmetic Act, the Illinois Controlled Substances Act, and the Cannabis and Controlled Substances Tort Claims Act to provide that persons engaged in donating or accepting, or packaging, repackaging, or labeling, prescription drugs to the extent permitted or required under the Cancer Drug Repository Program Act are exempt from provisions of those other Acts that might prohibit or otherwise regulate such activity.
