Synopsis As Introduced Amends the Illinois Dental Practice Act. Provides that "dental service", as the term relates to those services performed by a dental assistant under the supervision and full responsibility of a dentist and therefore exempt from the operation of the Act, does not include the administration of anesthetics, except for (A) the application of topical anesthetics and (B) the monitoring of nitrous oxide, conscious sedation, deep sedation, and general anesthesia (now, except for the application of topical anesthetics and monitoring of nitrous oxide), each of which may be performed after successful completion of a training program approved by the Department of Financial and Professional Regulation. Provides that it is unlawful for any dentist licensed under the Act to use the term "sedation dentistry" or similar terms in advertising unless the advertising dentist holds a valid and current permit issued by the Department to administer either general anesthesia or conscious sedation. Effective immediately.
Deletes everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes. Provides that no licensed dentist shall administer general anesthesia, deep sedation, or conscious sedation (now, just general anesthesia or conscious sedation) without first applying for and obtaining a permit for that purpose from the Department of Financial and Professional Regulation. Makes a related change. Requires the Department, by rule, to establish and ensure certain requirements and standards in determining minimum permit qualifications necessary to protect public safety and sets forth certain professional guidelines that the Department must consider in establishing the requirements. Requires an appropriate permit for the performance of dentistry by a licensed dentist while a nurse anesthetist administers conscious sedation, deep sedation, or general anesthesia, and requires the existence of a written collaborative agreement between the dentist and the nurse anesthetist. Restores current law in the Section concerning acts that constitute the practice of dentistry. Removes the immediate effective date.
House Floor Amendment No. 2 In the Section concerning permits for the administration of anesthesia and sedation, provides that a valid written practice (instead of collaborative) agreement must exist between the dentist who performs dentistry and the nurse anesthetist who administers sedation or anesthesia.
