Synopsis As Introduced
Creates the Mercury Thermostat Collection Act. Requires thermostat manufacturers to establish and maintain a program for the collection and recycling of mercury thermostats. Sets forth requirements for the Program. Requires that mercury thermostats be handled as universal waste. Prohibits wholesalers, retailers, and technicians from selling or distributing non-mercury thermostats if they have not taken certain actions with respect to the disposal of mercury thermostats. Sets forth penalties for violations of the Act. Requires the Environmental Protection Agency to publish certain information and make recommendations to the Governor and General Assembly concerning the collection of mercury thermostats. Contains other provisions. Amends the Environmental Protection Act. Prohibits the sale or distribution of button cell batteries that contains mercury. Prohibits the sale or distribution of certain mercury-added products. Effective immediately.

House Committee Amendment No. 1
In the Mercury Thermostat Collection Act, provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. In the Environmental Protection Act, requires the Governor, in coordination with the Environmental Protection Agency, to propose rules to the General Assembly concerning the processing mercury-added products (instead of requiring the Agency to adopt the rules).

House Committee Amendment No. 2
Deletes reference to:
415 ILCS 5/22.23b

Deletes the provisions amending the Environmental Protection Act.

House Committee Amendment No. 3
Deletes a provision that thermostat retailers may not sell non-mercury thermostats unless they provide educational materials. Requires the Environmental Protection Agency to develop an educational template to be made available to businesses and consumers to inform consumers about programs for the collection of mercury thermostats.

 Fiscal Note, House Committee Amendment No. 2 (Illinois Environmental Protection Agency)
 This legislation will have no fiscal impact on the Illinois EPA. The Agency would use its existing resources to oversee the mercury thermostat collection program.
