Synopsis As Introduced
Amends the Radon Industry Licensing Act. Requires the Illinois Emergency Management Agency, in coordination with the Environmental Protection Agency and the Pollution Control Board, to adopt rules for radon control for all new residential buildings. Requires that these rules incorporate the radon control methods set forth in the International Residential Code. Effective immediately.

Deletes everything after the enacting clause. Creates the Radon-Resistant Residences Act. Creates the Radon-Resistant Building Codes Task Force for the purpose of making recommendations to the Governor, the Illinois Emergency Management Agency, the Environmental Protection Agency, and the Pollution Control Board concerning the adoption of rules for building codes. Requires the Governor, in coordination with the Agency, the Environmental Protection Agency, and the Pollution Control Board, to propose rules to the General Assembly for radon control for all new residential buildings in the State. Requires that these rules incorporate the radon control methods set forth in the International Residential Code. Effective immediately.

Deletes everything after the enacting clause. Creates the Radon-Resistant Residences Act. Creates the Radon-Resistant Building Codes Task Force for the purpose of making recommendations to the Governor, the Illinois Emergency Management Agency, the Environmental Protection Agency, and the Pollution Control Board concerning the adoption of rules for building codes. Provides that the Radon-Resistant Building Codes Task Force consists of the following members: the Director of the Illinois Emergency Management Agency; eight representatives designated by the Director of the Illinois Emergency Management Agency from specified types of organizations; one member appointed by the Speaker of the House; one member appointed by the Minority Leader of the House; one member appointed by the President of the Senate; and one member appointed by the Minority Leader of the Senate. Provides that there is no rulemaking authority under the amendatory Act, but that the Governor shall propose rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Amends the Illinois Radon Awareness Act. Provides that the Act does not apply to transfers of structures or buildings containing more than 4 residential dwelling units and transfers of residential dwelling units located on the third story or higher of any structure or building. Makes changes to the Disclosure of Information on Radon Hazards form required to be provided to buyers of residential real property. Makes changes to the definition of "residential real property". Effective immediately.
