Synopsis As Introduced
Amends the Illinois Public Aid Code. Provides that under the medical assistance program, an immunosuppressive drug shall not require prior authorization, step therapy, generic substitution, or quantity limits without express written or oral notification and the documented consent of the practitioner and the patient. Defines "immunosuppressive drug" as a drug that is issued in immunosuppressive therapy to inhibit or prevent activity of the immune system and is used to prevent the rejection of transplanted organs and tissues. Provides that immunosuppressive drugs do not include drugs for the treatment of autoimmune diseases or diseases that are most likely of autoimmune origin. Effective immediately.

Replaces everything after the enacting clause. Amends the Illinois Public Aid Code. Provides that subject to appropriation, beginning on July 1, 2008, the Department of Human Services shall increase TANF grant amounts in effect on June 30, 2008 by 15%; provides that the Department is authorized to administer this increase but may not otherwise adopt any rule to implement this increase. Adds provisions concerning Family Care medical assistance eligibility for caretaker relatives age 19 years or older when countable income is at or below 185% of the Federal Poverty Level Guidelines. Provides that eligibility shall be reviewed annually. Provides that caretaker relatives enrolled under these provisions in families with countable income above 150% and at or below 185% of the Federal Poverty Level Guidelines shall be counted as family members and pay premiums as established under the Children's Health Insurance Program Act. Adds other provisions concerning payment of premiums, re-enrollment after termination of coverage, and restrictions on rulemaking to implement these provisions. Effective immediately.
