Synopsis As Introduced
Amends the Illinois Vehicle Code. Provides that a person is guilty of a Class C misdemeanor if he or she causes the death of another person by failing to follow the required procedures when approaching a stationary authorized emergency vehicle that is giving a warning signal. Provides that imposition of the penalties authorized by the provision does not preclude the imposition of appropriate additional civil or criminal penalties.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Illinois Vehicle Code. Reinserts the provisions of the bill, except that the court may consider a violation that results in the death of another person either as a business offense punishable by a fine of not less than $100 nor more than $10,000 or as a Class A misdemeanor.

Senate Committee Amendment No. 1
Adds reference to:
720 ILCS 5/9-3from Ch. 38, par. 9-3

Deletes a provision relating to the penalty for failure to exercise due caution and yielding to an emergency vehicle that results in the death of another person, that permits the court to either consider the offense as a business offense punishable by a fine of not less than $100 nor more than $10,000 or as a Class A misdemeanor. Restores a provision that allows a person's driving privilege to be suspended for a violation. Amends the Criminal Code of 1961 relating to reckless homicide. Provides that in cases involving reckless homicide in which the defendant unintentionally kills an individual, the trier of fact may infer that the defendant's actions were performed recklessly where he or she was also violating the provisions of the Illinois Vehicle Code for failure to exercise due caution and yielding to an emergency vehicle. Provides that the penalty for a reckless homicide in which the driver also violated such provisions of the Illinois Vehicle Code is a Class 2 felony, for which a person, if sentenced to a term of imprisonment, shall be sentenced to a term of not less than 3 years and not more than 14 years.
