Synopsis As Introduced
Amends the Copper Purchase Registration Law. Changes the short title to the Recyclable Metal Purchase Registration Law. Provides that, for each purchase of recyclable metal, a recyclable metal dealer must enter specified information on a form provided by the Department of State Police. Requires the recyclable metal dealer to: copy the seller's drivers license or state-issued identification card; photograph the items of recyclable metal purchased; and photograph the license plate and the side of the vehicle or conveyance on which the recyclable metal was delivered or use a security camera to record the license plate and the side of the vehicle or conveyance. Provides that security camera recordings must be retained for 90 days. Provides for reporting to local law enforcement and changes provisions exempting certain municipalities that provide for the registration of recyclable metal. Provides that violation of the Act is a Class A misdemeanor for a second offense and a Class 4 felony for a third or subsequent offense.

Deletes everything after the enacting clause. Amends the Illinois Vehicle Code. Provides that every person licensed as a scrap processor and every recyclable metal dealer shall maintain for 3 years, at his or her established place of business, specified records relating to the acquisition of scrap metals having a value of $100 or more. Provides that a scrap processor shall verify and record the identity of each person from whom scrap metals are acquired. Creates exemptions to these requirements. Provides that authorized representatives of the Secretary of State may inspect the premises of a scrap processor more than 6 times during a 6-month period if one or more of the inspections is an inspection is of records relating to acquisition of scrap metals or of a vehicle, junk vehicle, or vehicle cowl that was acquired for the purpose of processing into a form other than a vehicle, junk vehicle, or vehicle cowl. Provides that a scrap processor or recyclable metal dealer may not purchase metal beer kegs from any person other than the beer manufacturer whose identity is stamped on the keg, or the manufacturer's representative. Requires the purchaser to obtain proof of ownership from the seller. Sets requirements for proof of ownership.

Senate Floor Amendment No. 2
Provides that, for scrap metals valued at $100 or more, the scrap processor or recyclable metal dealer shall verify and record the identity of the person from whom the scrap metals were acquired by recording the identification of that person from the person's driver's license or State Identification Card (instead of from at least 2 sources of identification, one of which shall be a driver's license or State Identification Card) on the scrap processor or recyclable metal dealer's weight ticket.
