| According to the Secretary of State's Office, in 2007 (the latest data available) there were just over 50,000 arrests for DUI, of which 95% resulted in either convictions or court supervision. If each one of these 47,500 cases were assessed the $50 fine proposed by this bill, that would generate $2,375,000 per year. Under the current provisions of the Roadside Memorial Act, markers are placed only be request of the family of the deceased and they are charged for the cost of placing the marker. Although this bill would increase spending by the Department, those payments would not exceed the revenues from this new source and, more importantly, would relieve the families of some, or all, of the burden of having memorial markers placed. It should also be noted that these payments would not come at the expense of other highway program resources. These changes would require a corresponding appropriation to the Department from the new Roadside Memorial Fund. |
