Synopsis As Introduced
If and only if Senate Bill 500 becomes law, then amends the Smoke Free Illinois Act to provide that smoking is allowed in a private club that has been in active and continuous existence prior to January 1, 2008, whether incorporated or not, and that can provide written documentation that three-fifths of its active members approve of smoking on the club's premises.

House Committee Amendment No. 1
Deletes reference to:
95SB500enr, Sec. 35
Adds reference to:
410 ILCS 82/35

Deletes everything after the enacting clause. Amends the Smoke Free Illinois Act to allow smoking in a private club, provided that at least three-fifths of its members have requested in writing that the private club designate areas for smoking (rather than approve of smoking on the club's premises). Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.
