Synopsis As Introduced
Amends the Illinois Public Aid Code. Provides that as a condition of eligibility to participate in the child care assistance program, a child care provider must authorize in writing an investigation to determine whether the child care provider has ever been charged with a crime and, if so, the disposition of those charges. Provides for confidentiality of information received by the Department of Human Services. Eliminates a provision that the Department of Human Services shall request the Department of Children and Family Services to conduct periodic investigations of the Central Register maintained under the Abused and Neglected Child Reporting Act. Effective immediately.

Changes the bill title. Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to create a task force to examine the process used by State and local governmental agencies to conduct criminal history record checks as a condition of employment or approval to render provider services to such an agency. Provides for the task force membership. Requires a report to the General Assembly by February 1, 2009, and sets forth items that must be included.

House Committee Amendment No. 1
Replaces everything after the enacting clause with substantially similar provisions, amending the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois and the Illinois Public Aid Code, but with changes that include the following: (1) provides that the Department of Public Health shall create the task force in collaboration with the Department of State Police; (2) adds representatives from the Department of Central Management Services and the Department of Healthcare and Family Services to the task force; (3) provides that the representative or representatives of the State Board of Education shall consult with certain other entities; (4) provides that the Department of Public Health and the Department of State Police shall jointly provide administrative and staff support to the task force as needed; (5) requires the task force to provide a plan by August 1 (instead of February 1), 2009; (6) adds that the task force shall identify any areas where State-mandated criminal history record checks can be implemented in a more efficient and cost-effective manner; and (7) provides that any child care provider, other than a relative of the child, receiving funds from the child care assistance program under the Illinois Public Aid Code who is not required to be licensed under the Child Care Act of 1969 shall, as a condition of eligibility to participate in the child care assistance program under the Code, authorize in writing an investigation to determine if the child care provider has ever been convicted of a crime. Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Effective immediately.
