Synopsis As Introduced
Amends the Emergency Telephone System Act. Provides that all 9-1-1 system providers must comply with specified requirements in the Public Utilities Act. Amends the Public Utilities Act. Provides that, beginning July 1, 2009, it shall be unlawful for any 9-1-1 system provider to offer or provide or seek to offer or provide to any emergency telephone system board or 9-1-1 system, or agent, representative, or designee thereof, any network or database service used or intended to be used by any emergency telephone system board or 9-1-1 system for the purpose of answering, transferring, or relaying requests for emergency services, or dispatching public safety agency personnel in response to requests for emergency services, unless the 9-1-1 system provider has applied for and received a Certificate of 9-1-1 System Provider Authority from the Illinois Commerce Commission. Provides that no incumbent local exchange carrier that provides, as of the effective date of the amendatory Act, any 9-1-1 network or 9-1-1 database service used or intended to be used by any Emergency Telephone System Board or 9-1-1 system, shall be required to obtain a Certificate of 9-1-1 System Provider Authority under specified provisions. Provides that any and all enforcement authority granted to the Commission under specified provisions over any Certificate of Service Authority shall apply equally and without limitation to a Certificate of 9-1-1 System Provider Authority. Provides that the Commission is authorized to promulgate any rules it deems necessary to implement specified requirements. Effective immediately.

Senate Committee Amendment No. 1
Deletes everything after the enacting clause. Reinserts the contents of the introduced bill with the following changes. Adds language providing that the enforcement authority granted to the Commission under specified provisions shall apply exclusively to 9-1-1 system providers, and to incumbent local exchange carriers only to the extent the local exchange carriers act as 9-1-1 system providers. Deletes language providing that the Commission is authorized to promulgate any rules it deems necessary to implement the requirements of this specified provisions. Effective immediately.

Senate Floor Amendment No. 3
Deletes everything after the enacting clause. Reinserts the contents of the introduced bill with the following changes. Provides that except as otherwise provided in specified provisions, beginning July 1, 2009, it is unlawful for any 9-1-1 system provider to offer or provide or seek to offer or provide to any emergency telephone system board or 9-1-1 system, or agent, representative, or designee thereof, any network and database service (instead of any network or database service) used or intended to be used by any emergency telephone system board or 9-1-1 system for the purpose of answering, transferring, or relaying requests for emergency services, or dispatching public safety agency personnel in response to requests for emergency services, unless the 9-1-1 system provider has applied for and received a Certificate of 9-1-1 System Provider Authority from the Illinois Commerce Commission. Provides that no incumbent local exchange carrier that provides, as of the effective date of the amendatory Act, any 9-1-1 network and 9-1-1 database service (instead of any 9-1-1 network or 9-1-1 database service) used or intended to be used by any Emergency Telephone System Board or 9-1-1 system, shall be required to obtain a Certificate of 9-1-1 System Provider Authority under specified provisions. Provides that no entity that possesses, as of the effective date of the amendatory Act, a Certificate of Service Authority and provides 9-1-1 network and 9-1-1 database services (instead of 9-1-1 network or 9-1-1 database services) to any incumbent local exchange carrier as of the effective date of the amendatory Act shall be required to obtain a Certificate of 9-1-1 System Provider Authority under specified provisions. Changes language to provide that any and all enforcement authority granted to the Commission under specified provisions shall apply exclusively to 9-1-1 system providers granted a Certificate of Service Authority under specified provisions and shall not apply to incumbent local exchange carriers that are providing 9-1-1 service as of the effective date of the amendatory Act. Effective immediately.

House Committee Amendment No. 1
Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.
