Synopsis As Introduced
Contains a preamble concerning COVID-19, the Gubernatorial Disaster Proclamations declaring all counties in the State of Illinois as a disaster area, and other matters. Defines "covered person" to include individuals meeting specified criteria involving income, ability to pay a full rent or housing payment, efforts to make timely partial payments, and the likely effects of eviction. Pursuant to the Illinois Emergency Management Agency Act and consistent with the powers set forth in the State's public health laws, orders, effective November 13, 2020, that: (i) a person or entity may not commence a residential eviction action against a covered person unless the person poses a direct threat to the health and safety of other tenants or an immediate and severe risk to property; (ii) all State, county, and local law enforcement officers in the State of Illinois shall cease enforcement of orders of eviction for residential premises unless the tenant, lessee, sublessee, or resident of the residential property has been found to pose a direct threat to the health and safety of other tenants or an immediate and severe risk to property; (iii) nothing in this Executive Order shall be construed as relieving any individual of the obligation to pay rent or comply with any other obligation that an individual may have pursuant to a lease or rental agreement. Provides that the provisions of this Executive Order are severable.
