Synopsis As Introduced
Contains a preamble concerning COVID-19, the Gubernatorial Disaster Proclamations declaring all counties in the State of Illinois as a disaster area, and other matters. Pursuant to the Illinois Emergency Management Agency Act, orders the following for the duration of the Gubernatorial Disaster Proclamations: (1) the requirement that a couple "appear before" the county clerk to obtain a marriage license set forth in the Illinois Marriage and Dissolution of Marriage Act may be satisfied if the couple appears before the county clerk using two-way audio-video communication technology, the county clerk has the necessary technological compatibilities, and specified conditions are met; participating county clerks may provide guidance related to how marriage license applications and issuance will be implemented in their jurisdictions; (2) a marriage solemnization ceremony under the Illinois Marriage and Dissolution of Marriage Act may be performed using two-way audio-video communication technology if specified conditions are met; (3) the requirement under the Illinois Marriage and Dissolution of Marriage Act that a fully executed marriage license must be submitted to the county clerk within 10 days is suspended; (4) the 60-day expiration time frame for marriage licenses obtained from the county clerk under the Illinois Marriage and Dissolution of Marriage Act is suspended; licenses that have expired or are set to expire during the period of the Gubernatorial Disaster Proclamations are extended for the duration of the Gubernatorial Disaster Proclamations; (5) the requirement that a marriage license becomes effective one day after the date of issuance as set forth in the Illinois Marriage and Dissolution of Marriage Act is suspended for couples who have obtained the marriage license by appearing before the county clerk using two-way audio-video communication technology. Provides that the provisions of this Executive Order are severable.
