Synopsis As Introduced
Revokes and rescinds Executive Order 18-06. Lists and adopts recommendations of the Fair Practices in Contracting Task Force and orders State agencies to comply with the recommendations. Requires State agencies to submit contracts over $100,000 to the Business Enterprise Program for goal setting. Provides that the Department of Central Management Services shall issue guidance to each State agency to identify appropriate management and contracting personnel and amend position descriptions to include engagement with Program contractors and subcontractors and support for the goals of the Program and the Task Force. Provides for: guidance to State agencies to ensure compliance with the Program on contracts; review of contractual language regarding cancellation of contracts deemed noncompliant with the Program; and an outreach strategy to address the underrepresentation of African-American-owned businesses in State contracts. Declares that addressing the underrepresentation of African-American vendors in State contract awards is a compelling interest of the State and states policy goals. Creates the Illinois African-American Fair Contracting Commission to study African-American-owned businesses and their participation in State contracting, Sets forth the Commission's duties and membership. Contains provisions regarding: savings; prior executive orders; severability; and other matters. Effective immediately, except provisions regarding the Commission take effect January 3, 2019.
