Synopsis As Introduced
Amends the Code of Civil Procedure. Makes a technical change in a Section concerning nonjoinder and misjoinder of parties.

735 ILCS 5/22-105

Deletes everything after the enacting clause. Further amends the Code of Civil Procedure. Provides that if a prisoner confined in a Department of Corrections facility files a legal document seeking post-conviction relief under Article 122 or Section 116-3 of the Code of Criminal Procedure of 1963, in a habeas corpus action, in a second or subsequent petition for relief from judgment under Section 2-1401 of the Code of Civil Procedure, under Article X of the Code of Civil Procedure, in a claim under the Court of Claims Act, or in another action (instead of under Article 122 or Section 116-3 of the Code of Criminal Procedure of 1963, in a habeas corpus action, under Article X of the Code of Civil Procedure, in a claim under the Court of Claims Act, or in another action) against the State, the Department, the Prisoner Review Board, or any of their officers or employees and the court finds that the legal document is frivolous, the prisoner is responsible to pay in full the filing fees and actual court costs.
