AMENDMENT TO SENATE BILL 3032

2    AMENDMENT NO. ______. Amend Senate Bill 3032 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. The Children and Family Services Act is amended
5by adding Section 39.4 as follows:
 
6    (20 ILCS 505/39.4 new)
7    Sec. 39.4. Child Death Investigation Task Force. The
8Department of Children and Family Services may, from funds
9appropriated by the Illinois General Assembly to the Department
10of Children and Family Services, or from funds that may
11otherwise be provided for this purpose from other public or
12private sources, establish in the Southern Region of the State,
13as designated by the Department of Children and Family
14Services, a special Child Death Investigation Task Force to
15develop and implement a plan for: (i) the investigation of
16sudden, unexpected, or unexplained deaths of children under 18

1years of age occurring within that region and (ii) the
2investigation of missing and runaway children and children who
3are victims of sex trafficking within that region. The plan
4shall include a protocol to be followed. The plan must include
5provisions for local or State law enforcement agencies,
6hospitals, or coroners to promptly notify the Task Force of a
7death or serious life-threatening injury to a child, and for
8the Child Death Investigation Task Force to review the death
9and submit a report containing findings and recommendations to
10the Child Death Review Teams Executive Council, the Director of
11Public Health, the Director of Children and Family Services,
12the Department of Children and Family Services Inspector
13General, the appropriate State's Attorney, and the State
14Representative and State Senator in whose legislative
15districts the case arose. The plan may include coordination
16with any investigation conducted under the Children's Advocacy
17Center Act. On July 1 of each year, the Task Force shall submit
18a report to the Director of Children and Family Services, the
19General Assembly, and the Governor summarizing the results of
20the program together with any recommendations for statewide
21implementation of a protocol for the investigation of all
22sudden, unexpected, or unexplained child deaths and for the
23investigation of all cases involving missing and runaway
24children and children who are victims of sex trafficking.
 
25    Section 5. The Child Death Review Team Act is amended by

1adding Section 50 as follows:
 
2    (20 ILCS 515/50 new)
3    Sec. 50. Child Death Review Team Transfer Task Force.
4    (a) The Child Death Review Team Transfer Task Force is
5created within the Department of Children and Family Services
6to develop an implementation plan to effectuate the transfer of
7the administration of all child death review teams from the
8Department of Children and Family Services to the Department of
9Public Health. The implementation plan shall provide for the
10complete transfer of all child death review teams to the
11Department of Public Health by July 1, 2018.
12    (b) The Task Force shall be co-chaired by the Director of
13Children and Family Services and the Director of Public Health
14and shall consist of the following members appointed as
15follows:
16        (1) One project manager appointed by the Director of
17    Children and Family Services.
18        (2) One pediatrician knowledgeable about child abuse
19    and neglect appointed by the Director of Children and
20    Family Services.
21        (3) One forensic pathologist appointed by the Director
22    of Public Health.
23    The Director of Children and Family Services and the
24Director of Public Health may each appoint additional members
25as necessary to carry out the functions of the Task Force.

1    (c) Members of the Task Force shall serve without
2compensation. Any vacancy occurring in the membership of the
3Task Force shall be filled in the same manner as the original
4appointment.
5    (d) The Department of Children and Family Services shall
6provide administrative support to the Task Force.
7    (e) The Task Force is abolished and this Section is
8repealed on July 1, 2018.

11repealing Section 45.".
