1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Higher Education Cooperation Act is amended
5by changing Sections 2, 3, 4, and 5 and by adding Section 2.5
6as follows:

8    Sec. 2. As used in this Act, unless the context otherwise
9requires:
10    "Board" means the Board of Higher Education. ;
11    "Nonpublic institution of higher education" means a
12nonpublic college or university that (i) has been authorized to
13operate within the State of Illinois pursuant to the Private
14College Act or the Academic Degree Act, (ii) has been in
15continuous operation and has granted degrees within the State
16of Illinois since before the effective date of both the Private
17College Act and the Academic Degree Act and has not modified
18the business entity since the effective date of both the
19Private College Act and the Academic Degree Act, or (iii) has
20been authorized pursuant to the Private Business and Vocational
21Schools Act of 2012. an educational organization, other than a
22public institution of higher education, which provides a
23minimum of an organized 2 year program at the private junior

1college level or higher and which operates not-for-profit and
2in conformity with standards substantially equivalent to those
3of the public institutions of higher education;
4    "Private partner" means a private business, industry,
5labor organization, not-for-profit organization, association,
6foundation, or corporation that partners with one or more
7public institutions of higher education or with one or more
8nonpublic institutions of higher education or with both public
9and nonpublic institutions of higher education pursuant to an
10agreement under this Act.
11    "Private resources" means support, whether financial or
12in-kind assistance, from a private partner that may be used to
13provide matching support under this Act.
14    "Public institution of higher education" means the
15University of Illinois, Southern Illinois University, Chicago
16State University, Eastern Illinois University, Governors State
17University, Illinois State University, Northeastern Illinois
18University, Northern Illinois University, Western Illinois
19University, the public community colleges of this State, and
20any other public universities, colleges and community colleges
21now or hereafter established or authorized by the General
22Assembly.
23    "Public-private partnership" means an agreement pursuant
24to this Act between one or more public institutions of higher
25education and a nonpublic institution of higher education, a
26private partner, or a combination of both that leverages

1resources from all parties to improve higher education
2outcomes.
3    "Public resources" means support, whether financial or
4in-kind assistance, from a public entity that may be used to
5provide matching support under this Act.

8    Sec. 2.5. Purpose. The purpose of this Act is to promote
9interinstitutional cooperation and public-private partnerships
10in order to leverage the use of public and private resources to
11provide workforce-valuable postsecondary education to improve
12outcomes for the higher educational system in this State.

14    Sec. 3. Any public institution of higher education may
15participate in the establishment and operation of programs of
16interinstitutional cooperation with other public institutions
17of higher education, or with nonpublic institutions of higher
18education, or with both public and nonpublic institutions of
19higher education, or with private partners. Such participation
20may be by contract or by other means, including, but not
21limited to, the designation of representatives of the
22institution as directors of not-for-profit corporations
23organized for the governance or administration of any such
24program. Public institutions of higher education may

1participate in programs of interinstitutional cooperation or
2public-private partnerships that programs which involve
3institutions or private partners based outside this State.

6    Sec. 4. A program of financial assistance to programs of
7interinstitutional cooperation and public-private
8partnerships , in higher education is established to implement
9the policy of encouraging such cooperation in order to achieve
10an efficient use of educational resources, an equitable
11distribution of educational services, the development of
12innovative concepts and applications, and other public
13purposes.
14    The Board of Higher Education shall administer this program
15of financial assistance and shall distribute the funds
16appropriated by the General Assembly for this purpose in the
17form of grants to not-for-profit corporations organized to
18administer programs of interinstitutional cooperation in
19higher education or to public or nonpublic institutions of
20higher education participating in such programs.
21    In awarding grants to interinstitutional programs and
22public-private partnerships under this Act, the Board shall
23consider in relation to each such program whether it serves the
24public purposes expressed in this Act, whether the local
25community is substantially involved, whether its function

1could be performed better by a single existing institution,
2whether the program is consistent with the Illinois master plan
3for higher education, and such other criteria as it determines
4to be appropriate.
5    No grant may be awarded under this Section for any program
6of sectarian instruction or for any program designed to serve a
7sectarian purpose.
8    As a part of its administration of this Act, the Board may
9require audits or reports in relation to the administrative,
10fiscal, and academic aspects of any program of
11interinstitutional cooperation or public-private partnership
12program for which a grant is awarded under this Act. The Board
13may require the contribution of matching resources. The Board
14shall annually submit to the Governor and the General Assembly
15a budgetary recommendation for grants under this Act.

18    Sec. 5. Any not-for-profit corporation organized to
19administer a program of an interinstitutional cooperation
20program of higher education or public-private partnership may
21be recognized under this Section if it has been in existence
22for 3 years or longer, it is structured for continuing
23operation, it is substantial in scope, it is oriented to and
24supported by the community in which it is located, and it is
25consistent with the Illinois master plan for higher education.

1    In each request of the Board of Higher Education to the
2General Assembly for the appropriation of funds for the purpose
3of making grants under this Act the Board shall specify the
4amount of the grant proposed for each not-for-profit
5corporation recognized under this Section.
6    The following not-for-profit corporations are recognized
7for the purposes of this Section:
8    The Quad Cities Graduate Study Center.
