SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/7-155  from Ch. 108 1/2, par. 7-155

    Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Deletes the one-year limit on backdating a survivor benefit. Effective immediately.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by changing
5Section 7-155 as follows:
 
6    (40 ILCS 5/7-155)  (from Ch. 108 1/2, par. 7-155)
7    Sec. 7-155. Surviving spouse annuities-commencement. A
8surviving spouse annuity shall begin on the 1st day of the
9month next following the month in which the participating
10employee, or the employee annuitant or such person entitled to
11a retirement annuity died, upon a written application therefor,
12provided:
13    1. (Blank). Such date is not more than one year prior to
14the date the application was received by the Board; and
15    2. The amount of surviving spouse annuity before the
16application of paragraph 3 of Section 7-158, is at least $5 per
17month, beginning on such date.
