1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing Section 8-2-9.1 as follows:
 
6    (65 ILCS 5/8-2-9.1)  (from Ch. 24, par. 8-2-9.1)
7    Sec. 8-2-9.1. Budget officer. Every municipality with with
8a population of less than 500,000 (except special charter
9municipalities having a population in excess of 50,000) that
10has adopted this Section 8-2-9.1 and Sections 8-2-9.2 through
118-2-9.10 by a two-thirds majority vote of those members of the
12corporate authorities then holding office shall have a budget
13officer who shall be designated by the mayor or president, with
14the approval of the corporate authorities. In municipalities
15operating under the commission form of government, the
16commissioner of accounts and finances shall designate the
17budget officer, with the approval of the council or board of
18trustees, as the case may be. In municipalities with a
19managerial form of government, the municipal manager shall
20designate the budget officer. The budget officer shall take an
21oath and post a bond as provided in Section 3.1-10-25. The
22budget officer may hold another municipal office, either
23elected or appointed, and may receive compensation for both

1offices. Article 10 of this Code shall not apply to an
2individual serving as the budget officer. The budget officer
3shall serve at the pleasure of the mayor or municipal manager,
4as the case may be.
