SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-605.4 new

    Amends the Illinois Vehicle Code. Provides that no person shall drive a motor vehicle and meet or overtake from either direction a stopped waste service vehicle at a speed in excess of 15 miles per hour. Provides for the circumstances in which the 15 mile per hour speed limitation on passing waste service vehicles shall apply. Makes a violation of this Section a petty offense with a minimum fine of $150. Imposes a fine of not less than $300 but no more than $1,000, or confinement in jail for not more than one year, or both, for a violation resulting in serious injury or death to a waste service vehicle worker. Defines the term, "waste service vehicle".

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-605.4 as follows:
 
6    (625 ILCS 5/11-605.4 new)
7    Sec. 11-605.4. Special speed limit while passing waste
8service vehicles.
9    (a) No person shall drive a motor vehicle and meet or
10overtake from either direction a stopped waste service vehicle
11at a speed in excess of 15 miles per hour.
12    (b) The speed limitation under subsection (a) of this
13Section applies only if:
14        (1) the waste service vehicle is identifiable as a
15    waste service vehicle based on the vehicle configuration or
16    marking on the vehicle;
17        (2) the waste service vehicle operator is giving a
18    visual signal by means of a stationary sign or by use of
19    amber oscillating, rotating, or flashing lights, as
20    authorized under paragraph 12 of subsection (b) of Section
21    12-215 of this Code, to warn of the presence of workers and
22    caution other drivers; and
23        (3) the waste service vehicle is not on a private

1    driveway, controlled access highway, interstate highway,
2    or highway with a center line and more than 2 lanes.
3    (c) For the purposes of this Section, "waste service
4vehicle" means any garbage collection vehicle, including a
5vehicle collecting recyclables or yard waste, which is used for
6curbside collection, makes frequent stops, and is not fully
7automated.
8    (d) Any person who violates subsection (a) is guilty of a
9petty offense with a minimum fine of $150. If a person violates
10subsection (a) and causes serious injury or death to a waste
11service vehicle worker, he or she shall be fined not less than
12$300 but no more than $1,000, or confined in jail for not more
13than one year, or both.
