2    AMENDMENT NO. ______. Amend Senate Bill 629 by replacing
3everything after the enacting clause with the following:
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 12-604.1 and by adding Sections 1-218.10 and
612-604.3 as follows:
7    (625 ILCS 5/1-218.10 new)
8    Sec. 1-218.10. Video event recorder. A video recorder
9placed inside a vehicle that continuously records, in a digital
10loop, audio, video, and G-force levels.

12    Sec. 12-604.1. Video devices.
13    (a) A person may not operate a motor vehicle if a
14television receiver, a video monitor, a television or video
15screen, or any other similar means of visually displaying a

1television broadcast or video signal that produces
2entertainment or business applications is operating and is
3located in the motor vehicle at any point forward of the back
4of the driver's seat, or is operating and visible to the driver
5while driving the motor vehicle.
6    (a-5) A person commits aggravated use of a video device
7when he or she violates subsection (a) and in committing the
8violation he or she was involved in a motor vehicle accident
9that results in great bodily harm, permanent disability,
10disfigurement, or death to another and the violation was a
11proximate cause of the injury or death.
12    (b) This Section does not apply to the following equipment,
13whether or not permanently installed in a vehicle:
14        (1) a vehicle information display;
15        (2) a global positioning display;
16        (3) a mapping or navigation display;
17        (4) a visual display used to enhance or supplement the
18    driver's view forward, behind, or to the sides of a motor
19    vehicle for the purpose of maneuvering the vehicle;
20        (5) television-type receiving equipment used
21    exclusively for safety or traffic engineering studies; or
22        (6) a television receiver, video monitor, television
23    or video screen, or any other similar means of visually
24    displaying a television broadcast or video signal, if that
25    equipment has an interlock device that, when the motor
26    vehicle is driven, disables the equipment for all uses

1    except as a visual display as described in paragraphs (1)
2    through (5) of this subsection (b).
3    (c) This Section does not apply to a mobile, digital
4terminal installed in an authorized emergency vehicle, a motor
5vehicle providing emergency road service or roadside
6assistance, or to motor vehicles utilized for public
8    (d) This Section does not apply to a television receiver,
9video monitor, television or video screen, or any other similar
10means of visually displaying a television broadcast or video
11signal if: (i) the equipment is permanently installed in the
12motor vehicle; and (ii) the moving entertainment images that
13the equipment displays are not visible to the driver while the
14motor vehicle is in motion.
15    (d-5) This Section does not apply to a video event
16recorder, as defined in Section 1-218.10 of this Code,
17installed in a contract carrier vehicle.
18    (e) Except as provided in subsection (f) of this Section, a
19person convicted of violating this Section is guilty of a petty
20offense and shall be fined not more than $100 for a first
21offense, not more than $200 for a second offense within one
22year of a previous conviction, and not more than $250 for a
23third or subsequent offense within one year of 2 previous
25    (f) A person convicted of violating subsection (a-5)
26commits a Class A misdemeanor if the violation resulted in

1great bodily harm, permanent disability, or disfigurement to
2another. A person convicted of violating subsection (a-5)
3commits a Class 4 felony if the violation resulted in the death
4of another person.

6    (625 ILCS 5/12-604.3 new)
7    Sec. 12-604.3. Video event recorder notice. A contract
8carrier vehicle carrying passengers that is equipped with a
9video event recorder shall have a notice posted in a visible
10location stating that a passenger's conversation may be
11recorded. Any data recorded by a video event recorder shall be
12the sole property of the registered owner or lessee of the
13contract carrier vehicle.".
