AMENDMENT TO SENATE BILL 579

2    AMENDMENT NO. ______. Amend Senate Bill 579 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Trustees Act is
5amended by changing Section 1 as follows:
 
6    (110 ILCS 310/1)  (from Ch. 144, par. 41)
7    Sec. 1. The Board of Trustees of the University of Illinois
8shall consist of the Governor and at least 12 trustees. Nine
9trustees shall be appointed by the Governor, by and with the
10advice and consent of the Senate. The other trustees shall be
11students, of whom one student shall be selected from each
12University campus.
13    Each student trustee shall serve a term of one year,
14beginning on July 1 or on the date of his or her selection,
15whichever is later, and expiring on the next succeeding June
1630.

1    Each trustee shall have all of the privileges of
2membership, except that only one student trustee shall have the
3right to cast a legally binding vote. The Governor shall
4designate which one of the student trustees shall possess, for
5his or her entire term, the right to cast a legally binding
6vote. Each student trustee who does not possess the right to
7cast a legally binding vote shall have the right to cast an
8advisory vote and the right to make and second motions and to
9attend executive sessions.
10    Each trustee shall be governed by the same conflict of
11interest standards. Pursuant to those standards, it shall not
12be a conflict of interest for a student trustee to vote on
13matters pertaining to students generally, such as tuition and
14fees. However, it shall be a conflict of interest for a student
15trustee to vote on faculty member tenure or promotion. For the
16purposes of this Section, a student member shall not be deemed
17to have a direct conflict of interest in and may vote on any
18item involving the employment or compensation of the Chancellor
19at any campus or the President of the University or the
20election of officers. Student trustees shall be chosen by
21campus-wide student election, and the student trustee
22designated by the Governor to possess a legally binding vote
23shall be one of the students selected by this method. A student
24trustee who does not possess a legally binding vote on a
25measure at a meeting of the Board or any of its committees
26shall not be considered a trustee for the purpose of

1determining whether a quorum is present at the time that
2measure is voted upon. To be eligible for selection as a
3student trustee and to be eligible to remain as a voting or
4nonvoting student trustee, a student trustee must be a resident
5of this State, must have and maintain a grade point average
6that is equivalent to at least 2.5 on a 4.0 scale, and must be a
7full time student enrolled at all times during his or her term
8of office except for that part of the term which follows the
9completion of the last full regular semester of an academic
10year and precedes the first full regular semester of the
11succeeding academic year at the University (sometimes commonly
12referred to as the summer session or summer school). If a
13voting or nonvoting student trustee fails to continue to meet
14or maintain the residency, minimum grade point average, or
15enrollment requirement established by this Section, his or her
16membership on the Board shall be deemed to have terminated by
17operation of law. The University may not use residency for
18tuition purposes as a factor in making the determination that a
19student is or is not a resident of this State. The following
20factors shall positively demonstrate residency in this State
21for the purposes of the residency requirement for student
22trustees and candidates for student trustee:
23        (1) evidence of the student's Illinois domicile for at
24    least the previous 6 months;
25        (2) evidence of the student's current, valid Illinois
26    driver's license; and

1        (3) evidence of the student's valid Illinois voter
2    registration.
3A positive demonstration of residency in this State for student
4trustees and candidates for student trustees under this Section
5does not apply to residency requirements for tuition purposes.
6    If a voting student trustee resigns or otherwise ceases to
7serve on the Board, the Governor shall, within 30 days,
8designate one of the remaining student trustees to possess the
9right to cast a legally binding vote for the remainder of his
10or her term. If a nonvoting student trustee resigns or
11otherwise ceases to serve on the Board, the chief executive of
12the student government from that campus shall, within 30 days,
13select a new nonvoting student trustee to serve for the
14remainder of the term.
15    No more than 5 of the 9 appointed trustees shall be
16affiliated with the same political party. Each trustee
17appointed by the Governor must be a resident of this State. A
18failure to meet or maintain this residency requirement
19constitutes a resignation from and creates a vacancy in the
20Board. The term of office of each appointed trustee shall be 6
21years from the third Monday in January of each odd numbered
22year. The regular terms of office of the appointed trustees
23shall be staggered so that 3 terms expire in each odd-numbered
24year.
25    Vacancies for appointed trustees shall be filled for the
26unexpired term in the same manner as original appointments. If

1a vacancy in membership occurs at a time when the Senate is not
2in session, the Governor shall make temporary appointments
3until the next meeting of the Senate, when he shall appoint
4persons to fill such memberships for the remainder of their
5respective terms. If the Senate is not in session when
6appointments for a full term are made, appointments shall be
7made as in the case of vacancies.
8    No action of the board shall be invalidated by reason of
9any vacancies on the board, or by reason of any failure to
10select student trustees.

12    Section 10. The Southern Illinois University Management
13Act is amended by changing Section 5 as follows:

16ballot from their own number a chairman who shall preside over
17meetings of the Board and a secretary.
18    Meetings of the Board shall be held at least once each
19quarter on a campus of Southern Illinois University. At all
20regular meetings of the Board, a majority of its voting members
21shall constitute a quorum. The student members shall have all
22of the privileges of membership, including the right to make
23and second motions and to attend executive sessions, other than
24the right to vote, except that the student member designated by

1the Governor as the voting student member shall have the right
2to vote on all Board matters except those involving faculty
3tenure, faculty promotion or any issue on which the student
4member has a direct conflict of interest. For the purposes of

7involving the employment or compensation of the Chancellor at
8any campus or the President of the University or the election
9of officers. A student member who is not entitled to vote on a
10measure at a meeting of the Board or any of its committees
11shall not be considered a member for the purpose of determining
12whether a quorum is present at the time that measure is voted
13upon. No action of the Board shall be invalidated by reason of
14any vacancies on the Board, or by reason of any failure to
15select a student member.
16    Special meetings of the Board may be called by the chairman
17of the Board or by any 3 members of the Board.
18    At each regular and special meeting that is open to the
19public, members of the public and employees of the University
20shall be afforded time, subject to reasonable constraints, to
21make comments to or ask questions of the Board.

222 years from his or her election and who shall preside over

21campus of Western Illinois University and all other meetings
22must be held on the campus of Western Illinois University at
23Macomb, Illinois. At all regular meetings of the Board, a
