AMENDMENT TO HOUSE BILL 6075

2    AMENDMENT NO. ______. Amend House Bill 6075 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 7-704 and 7-704.1 as follows:
 
6    (625 ILCS 5/7-704)
7    Sec. 7-704. Suspension to continue until compliance with
8court order of support.
9    (a) The suspension of a driver's license shall remain in
10effect unless and until the Secretary of State receives
11authenticated documentation that the obligor is in compliance
12with a court order of support or that the order has been stayed
13by a subsequent order of the court. Full driving privileges
14shall not be issued by the Secretary of State until
15notification of compliance has been received from the court.
16The circuit clerks shall report the obligor's compliance with a

1court order of support to the Secretary of State, on a form
2prescribed by the Secretary.
3    (a-1) The suspension of a driver's license shall remain in
4effect unless and until the Secretary of State receives
5authenticated documentation as to the person who violated a
6visitation order that the court has determined that there has
7been sufficient compliance for a sufficient period of time with
8the court's order concerning visitation and that full driving
9privileges shall be reinstated or that the order has been
10stayed by a subsequent order of the court. Full driving
11privileges shall not be issued by the Secretary of State until
12notification has been received from the court. The circuit
13clerk shall report any court order in which the court
14determined that there has been sufficient compliance for a
15sufficient period of time with the court's order concerning
16visitation and that full driving privileges shall be reinstated
17to the Secretary of State on a form prescribed by the
18Secretary.
19    (b) Whenever, after 2 suspensions one suspension of an
20individual's driver's license for failure to pay child support,
21another order of non-payment is entered against the obligor and
22the person fails to come into compliance with the court order
23of support, then the Secretary shall again suspend the driver's
24license of the individual and that suspension shall not be
25removed unless the obligor is in full compliance with the court
26order of support and has made full payment on all arrearages.

1    (b-1) Whenever, after one suspension of an individual's
2driver's license for failure to abide by a visitation order,
3another order finding visitation abuse is entered against the
4person and the court orders the suspension of the person's
5driver's license, then the Secretary shall again suspend the
6driver's license of the individual and that suspension shall
7not be removed until the court has determined that there has
8been sufficient compliance for a sufficient period of time with
9the court's order concerning visitation and that full driving
10privileges shall be reinstated.
11    (c) Section 7-704.1, and not this Section, governs the
12duration of a driver's license suspension if the suspension
13occurs as the result of a certification by the Illinois
14Department of Healthcare and Family Services under subsection
15(c) of Section 7-702.

18    Sec. 7-704.1. Duration of driver's license suspension upon
19certification of Department of Healthcare and Family Services.
20    (a) When a suspension of a driver's license occurs as the
21result of a certification by the Illinois Department of
22Healthcare and Family Services under subsection (c) of Section
237-702, the suspension shall remain in effect until the
24Secretary of State receives notification from the Department
25that the person whose license was suspended has paid the

1support delinquency in full or has arranged for payment of the
2delinquency and current support obligation in a manner
3satisfactory to the Department.
4    (b) Whenever, after 2 suspensions one suspension of an
5individual's driver's license based on certification of the
6Department of Healthcare and Family Services, another
7certification is received from the Department of Healthcare and
8Family Services, the Secretary shall again suspend the driver's
9license of that individual and that suspension shall not be
10removed unless the obligor is in full compliance with the order
11of support and has made full payment on all arrearages.
