1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-6-10 as follows:
 
6    (65 ILCS 5/11-6-10 new)
7    Sec. 11-6-10. Reimbursement of volunteer fire protection
8assistance.
9    (a) Municipalities may fix, charge, and collect fees not
10exceeding the reasonable cost of the service for all services
11rendered by a volunteer municipal fire department or a
12volunteer firefighter of any municipal fire department for
13persons, businesses, and other entities who are not residents
14of the municipality.
15    (b) The charge for any fees under subsection (a) shall be
16computed at a rate not to exceed $250 per hour and not to
17exceed $70 per hour per firefighter responding to a call for
18assistance. An additional charge may be levied to reimburse the
19district for extraordinary expenses of materials used in
20rendering such services. No charge shall be made for services
21for which the total amount would be less than $50.
22    (c) All revenue from the fees assessed pursuant to this
23Section shall be deposited to the general fund of the

1municipality.
2    (d) Nothing in this Section shall allow a fee to be fixed,
3charged, or collected that is not allowed under any contract
4that a fire department has entered into with another entity,
5including, but not limited to, a fire protection district.
 
6    Section 10. The Fire Protection District Act is amended by
7changing Section 11f as follows:
 
8    (70 ILCS 705/11f)  (from Ch. 127 1/2, par. 31f)
9    Sec. 11f. Charge against non-residents.
10    (a) The board of trustees of a fire protection district may
11fix, charge, and collect fees not exceeding the reasonable cost
12of the service for all services rendered by the district
13against persons, businesses and other entities who are not
14residents of the fire protection district.
15    (b) Such charge may not be assessed against residents of
16the fire protection district or persons who request fire
17protection coverage for an unprotected area and who pay to the
18fire protection district an amount equal to the district's Fire
19Protection Tax pursuant to Section 4 of the Fire Protection of
20Unprotected Area Act.
21    (c) The charge for such services shall be computed at a
22rate not to exceed $250 per hour per vehicle and not to exceed
23$70 per hour per firefighter responding to a call for
24assistance. An additional charge may be levied to reimburse the

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
