1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Interscholastic Athletic Organization Act
5is amended by adding Section 1.20 as follows:
 
6    (105 ILCS 25/1.20 new)
7    Sec. 1.20. Concussion reporting.
8    (a) Beginning with the 2016-2017 school year, an
9association or other entity that has, as one of its purposes,
10promoting, sponsoring, regulating, or in any manner providing
11for interscholastic athletics or any form of athletic
12competition among high schools and high school students within
13this State shall require all member schools that have certified
14athletic trainers to complete a monthly report on
15student-athletes at the member school who have sustained a
16concussion during a school-sponsored activity overseen by the
17athletic trainer or when the athletic director is made aware of
18a concussion sustained by a student during a school-sponsored
19event. All reporting must be anonymous as it relates to student
20names.
21    (b) Beginning with the 2017-2018 school year, the
22association or entity to which this Section applies shall
23compile the data reported under subsection (a) of this Section

1during the previous school year into an annual report and
2submit copies of this report to the General Assembly, as
3provided in Section 3.1 of the General Assembly Organization
4Act.
5    (c) With respect to reporting under this Section, an
6association or entity to which this Section applies and any
7member school shall have immunity from any liability, whether
8civil or criminal or that otherwise might result by reason of
9such action, except for willful or wanton misconduct. The
10association or entity has the authority to take action against
11a member school if the member school fails to complete the
12required reporting.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
