SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-821.2

    Amends the Illinois Vehicle Code. Provides that the Secretary of State shall not impose a delinquent registration renewal fee unless the registered owner of the vehicle has been provided with notice, by postage mail or email, of the date the vehicle's registration expires and that a delinquent registration renewal fee of $20 may be imposed for failure to send an application for registration renewal within one month after the vehicle's registration expires. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 3-821.2 as follows:

8    Sec. 3-821.2. Delinquent registration renewal fee. For
9registration renewal periods beginning on or after January 1,
102005, the Secretary of State may impose a delinquent
11registration renewal fee of $20 for the registration renewal of
12all passenger vehicles of the first division and motor vehicles
13of the second division weighing not more than 8,000 pounds if
14the application for registration renewal is received by the
15Secretary more than one month after the expiration of the most
16recent period during which the vehicle was registered. The
17Secretary shall not impose a delinquent registration renewal
18fee unless the registered owner of the vehicle has been
19provided with notice, by postage mail or email, of the date the
20vehicle's registration expires and that a delinquent
21registration renewal fee of $20 may be imposed for failure to
22send an application for registration renewal within one month
23after the vehicle's registration expires. If a delinquent

1registration renewal fee is imposed, the Secretary shall not
2renew the registration of such a vehicle until the delinquent
3registration renewal fee has been paid, in addition to any
4other registration fees owed for the vehicle. Active duty
5military personnel stationed outside of Illinois shall not be
6required to pay the delinquent registration renewal fee. If a
7delinquent registration renewal fee is imposed, the Secretary
8shall adopt rules for the implementation of this Section.

13    Section 95. No acceleration or delay. Where this Act makes
14changes in a statute that is represented in this Act by text
15that is not yet or no longer in effect (for example, a Section
16represented by multiple versions), the use of that text does
17not accelerate or delay the taking effect of (i) the changes
18made by this Act or (ii) provisions derived from any other
19Public Act.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
