AMENDMENT TO HOUSE BILL 4074

2    AMENDMENT NO. ______. Amend House Bill 4074 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 6-103.1 as follows:
 
6    (625 ILCS 5/6-103.1)
7    Sec. 6-103.1. New residents; out-of-state revocation.
8    (a) The Secretary of State may not issue a driver's license
9to a nonresident who becomes a resident of this State while the
10new resident's driving privileges are revoked, under terms
11similar to those provided in Section 1-176 of this Code, in
12another state; however, if the person has resided in this State
13for 10 or more consecutive years prior to submitting an
14application, that person may apply for licensure under Section
156-208 of this Code if:
16        (1) the laws of the revoking state would allow the

1    person to apply for licensure in that state;
2        (2) the person qualifies to apply for licensure under
3    Section 6-208;
4        (3) the out-of-state revocation is the only revocation
5    of driving privileges for the person;
6        (4) the person has not had any driving offenses since
7    the revocation, and the revocation is the only loss of the
8    person's driving privileges in any jurisdiction; and
9        (5) the person complies with the requirements of Title
10    92, Sections 1001.430 and 1001.440 of the Illinois
11    Administrative Code concerning the General Provisions for
12    Reinstatement of Driving Privileges After Revocation and
13    the Provisions for Alcohol and Drug Related Revocations,
14    Suspensions, and Cancellations.
15    (b) The Secretary may issue restricted driving permits to
16new residents whose driving privileges are revoked in another
17state. These permits must be issued according to the
18restrictions, and for the purposes, stated in Sections 6-205
19and 6-206 of this Code. The Secretary shall adopt rules for the
20issuance of these permits.
21    (c) A restricted driving permit issued under this Section
22is subject to cancellation, revocation, and suspension by the
23Secretary of State in the same manner and for the same causes
24as a driver's license issued under this Code may be cancelled,
25revoked, or suspended, except that a conviction of one or more
26offenses against laws or ordinances regulating the movement of

1traffic is sufficient cause for the revocation, suspension, or
2cancellation of a restricted driving permit.
