1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Springfield High Speed Railroad Oversight Act.
 
6    Section 5. Definitions. For purposes of this Act:
7    "Department" means the Department of Transportation.
8    "Minority owned business", "business owned by a person with
9a disability", and "female owned business" shall have the
10meanings provided in Section 2 of the Business Enterprise for
11Minorities, Females, and Persons with Disabilities Act.
12    "High Speed Rail Project" means the Illinois High Speed
13Rail Program, led by the Illinois Department of Transportation
14and the Federal Railroad Administration, which is designed to
15enhance the passenger transportation network in the
16Chicago-St. Louis corridor.
 
17    Section 10. Diversity program; purposes. The Department,
18the City of Springfield, and Sangamon County shall establish
19and maintain a diversity program to ensure environmental
20justice, as well as local involvement and non-discrimination,
21in all contracts related to the High Speed Rail Project in the
22City of Springfield and Sangamon County. The program shall do

1each of the following:
2    (1) Guarantee equal employment opportunities for socially
3and economically disadvantaged workers, particularly in areas
4affected by the High Speed Rail Project.
5    (2) Increase participation by minorities, women, and
6persons with disabilities in employment opportunities.
7Contracts related to the High Speed Rail Project shall meet a
8goal of at least 25% minority hiring.
9    (3) Increase participation by small businesses, minority
10owned businesses, businesses owned by a person with a
11disability, and female owned businesses in contracting.
12Contracts related to the High Speed Rail Project shall meet the
13Department's existing 22.77% Disadvantaged Business Enterprise
14participation goal for competitively let construction
15projects.
16    (4) Provide new funds equal to 1/2 of 1% of the project
17budget to local job training and support programs.
18    (5) Engage the full and fair participation of all
19potentially affected communities in the transportation
20decision making process concerning the construction of the High
21Speed Rail Project.
22    (6) Ensure compliance with all State and federal hiring
23regulations, including, but not limited to, goals for hiring
24women and minorities, and prohibitions on discrimination.
25    (7) Ensure proper support and adequate resources are
26available for the appointed rail relocation ombudsman.

1    If the implementation of any of the provisions of this
2Section 10 would negatively affect the receipt of federal
3funding, then the provisions of Section 10 shall not apply.
 
4    Section 15. Springfield High Speed Railroad Oversight
5Commission. The Springfield High Speed Railroad Oversight
6Commission ("Commission") is created to monitor, review, and
7report on contracting and employment related to the planning,
8organization, and construction of the High Speed Rail Project.
9The Commission shall consist of 13 members who shall be
10appointed, within 90 days of the effective date of this Act, as
11follows:
12    (1) One member of the Senate appointed by the President of
13the Senate, who shall serve as a Co-Chairperson of the
14Commission.
15    (2) One member of the House of Representatives appointed by
16the Speaker of the House, who shall serve as a Co-Chairperson
17of the Commission.
18    (3) One member of the Senate appointed by the Minority
19Leader of the Senate.
20    (4) One member of the House appointed by the Minority
21Leader of the House of Representatives.
22    (5) One member appointed by the Speaker of the House of
23Representatives representing the community surrounding the
24Springfield High Speed Railroad project area.
25    (6) One member appointed by the Governor representing

1community organizations operating within the community
2surrounding the High Speed Rail Project area in Springfield.
3    (7) One member appointed by the President of the Senate
4representing a minority chamber of commerce.
5    (8) One member appointed by the Minority Leader of the
6Senate who is a minority or female and a licensed professional
7engineer.
8    (9) One member appointed by the Minority Leader of the
9House of Representatives representing the City of Springfield.
10    (10) One member appointed by the President of the Senate
11representing Sangamon County.
12    (11) One member appointed by the Speaker of the House of
13Representatives representing a statewide labor organization.
14    (12) One member appointed by the Governor representing the
15Illinois Department of Transportation.
16    (13) The independent ombudsman for the 10th Street Rail
17Corridor.
 
18    Section 20. Commission meetings; authority; reporting. The
19Commission shall meet quarterly. The Commission shall have the
20authority to convene City, County, and Department officials to
21ensure compliance with the above stated goals.
22    On January 1, 2016, and on the first of each quarter
23thereafter until the completion of the High Speed Rail Project,
24the Commission shall issue a written report to the Governor,
25President of the Senate, Speaker of the House of

1Representatives, Minority Leader of the Senate, Minority
2Leader of the House of Representatives, Mayor of Springfield,
3Springfield City Council, Sangamon County Board, and the
4Department describing in detail the Project's compliance with
5the requirements of Section 10 of this Act. If in any reporting
6period any portion of the Project is not in compliance with its
7respective obligations, each entity that is not in compliance
8shall, by the end of the first month of the reporting period,
9file with the Commission a written explanation setting forth
10the reason or reasons for noncompliance. The Commission shall
11then meet within one week after receiving the written
12explanations to discuss the stated reason or reasons for
13noncompliance.
 
14    Section 25. Home rule. The requirements of this Act are
15exclusive powers and functions of the State. This Act is a
16denial and limitation of home rule powers and functions under
17subsection (h) of Section 6 of Article VII of the Illinois
18Constitution.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.
