AMENDMENT TO HOUSE BILL 3620

2    AMENDMENT NO. ______. Amend House Bill 3620, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Code of Civil Procedure is amended by
6adding Section 8-1403 as follows:
 
7    (735 ILCS 5/8-1403 new)
8    Sec. 8-1403. Interpreters for civil cases.
9    (a) Whenever any person is a party or witness in a civil
10action in this State, the court shall, upon its own motion or
11that of a party, determine whether the person is capable of
12understanding the English language and is capable of expressing
13himself or herself in the English language so as to be
14understood directly by counsel, court, or jury. If the court
15finds the person incapable of so understanding or so expressing
16himself or herself, the court shall appoint an interpreter for

1the person whom he or she can understand and who can understand
2him or her.
3    (b) The court shall enter an order of its appointment of
4the interpreter who shall be sworn to truly interpret or
5translate all questions propounded or answers given as directed
6by the court.
7    (c) All appointments for court interpreters in civil
8matters shall be subject to the Illinois Supreme Court Language
9Access Policy and the judicial circuit's Language Access Plan
10that is appropriate for the demands and resources specific to
11the Illinois courts within that particular circuit.
12    (d) As used in this Section, "interpreter" includes a sign
13language interpreter.".
