Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a provider of wireless telephone service may not use or permit the use of perma-cookies to monitor the viewing habits of their data plan users. Provides that a violation is an unlawful practice. Defines terms.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Consumer Fraud and Deceptive Business |
5 | | Practices Act is amended by adding Section 2TTT as follows: |
6 | | (815 ILCS 505/2TTT new) |
7 | | Sec. 2TTT. Perma-cookie prohibition. |
8 | | (a) "Perma-cookie" means a unique header tied to cellular |
9 | | telephone data plans that uniquely identify a user to the |
10 | | websites the user visits. |
11 | | (b) A provider of wireless telephone service may not use or |
12 | | permit the use of perma-cookies to monitor the viewing habits |
13 | | of its data plan users. |
14 | | (c) A violation of this Section is an unlawful practice |
15 | | within the meaning of this Act.
