SYNOPSIS AS INTRODUCED:
 
20 ILCS 3305/17.5

    Amends the Illinois Emergency Management Agency Act. Changes references from "Homeland Security Emergency Preparedness Fund" and "the Fund" to "Homeland Security Emergency Preparedness Trust Fund" and "the Trust Fund". Provides that the Trust Fund be a federal trust fund. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Emergency Management Agency Act is
5amended by changing Section 17.5 as follows:
 
6    (20 ILCS 3305/17.5)
7    Sec. 17.5. Homeland Security Emergency Preparedness Fund.
8The Homeland Security Emergency Preparedness Trust Fund is
9created as a federal trust fund special fund in the State
10treasury. The Trust Fund shall be held separate and apart from
11all public moneys or funds of this State. All Homeland Security
12moneys received by the Agency under Section 17 from a federal
13department or agency shall be deposited into the Trust Fund.
14Interest earned by the investment or deposit of moneys
15accumulated in the Trust Fund shall be deposited into the Trust
16Fund. The Agency is authorized to expend any moneys in the
17Trust Fund for the specific purposes established by the terms
18and conditions of the federal awards received by the Agency and
19in any amount that the Agency deems necessary to make grants
20and pay expenses in connection with its emergency management
21and preparedness programs.

1    Section 99. Effective date. This Act takes effect upon
