AMENDMENT TO HOUSE BILL 2736

2    AMENDMENT NO. ______. Amend House Bill 2736 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
510-20.12 as follows:
 
6    (105 ILCS 5/10-20.12)  (from Ch. 122, par. 10-20.12)
7    Sec. 10-20.12. School year - School age. To establish and
8keep in operation in each year during a school term of at least
9the minimum length required by Section 10-19, a sufficient
10number of free schools for the accommodation of all persons in
11the district who are 5 years of age or older but under 21 years
12of age, and to secure for all such persons the right and
13opportunity to an equal education in such schools; provided
14that (i) children who will attain the age of 5 years on or
15before December September 1 of the year of the 2017-2018

1attend school upon the commencement of such term and (ii) based
2upon an assessment of the child's readiness, children who have
3attended a non-public preschool and continued their education
4at that school through kindergarten, were taught in
5kindergarten by an appropriately certified teacher, and will
6attain the age of 6 years on or before December 31 of the year
7of the 2009-2010 school term and each school term thereafter
8may attend first grade upon commencement of such term. However,
9Section 33 of the Educational Opportunity for Military Children
10Act shall apply to children of active duty military personnel.
11Based upon an assessment of a child's readiness to attend
12school, a school district may permit a child to attend school
13prior to the dates contained in this Section. In any school
14district operating on a full year school basis children who
15will attain age 5 within 30 days after the commencement of a
16term may attend school upon the commencement of such term and,
17based upon an assessment of the child's readiness, children who
18have attended a non-public preschool and continued their
19education at that school through kindergarten, were taught in
20kindergarten by an appropriately certified teacher, and will
21attain age 6 within 4 months after the commencement of a term
22may attend first grade upon the commencement of such term. The
23school district may, by resolution of its board, allow for a
24full year school plan.
