AMENDMENT TO HOUSE BILL 1359




2    AMENDMENT NO. ______. Amend House Bill 1359 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Department of Professional Regulation Law 
5of the
Civil Administrative Code of Illinois is amended  by 
6adding Section 2105-170 as follows:
 
7    (20 ILCS 2105/2105-170 new)
8    Sec. 2105-170. Health care workers; automatic suspension 
9of license. A health care worker, as defined by the Health Care 
10Worker Self-Referral Act,  licensed by the Department shall be 
11automatically and indefinitely suspended at such time as the 
12final trial proceedings are concluded whereby a licensee has 
13been adjudicated and found guilty, or has entered a plea of 
14guilty or nolo contendere, in a criminal prosecution under the 
15laws of the State, the laws of any other state, or the laws of 
16the United States of America for any offense an essential

1element of which is defrauding Medicare, Medicaid, or any other 
2health insurance provider, or any offense arising out of any 
3investigation thereof.".
