AMENDMENT TO HOUSE BILL 735

2    AMENDMENT NO. ______. Amend House Bill 735 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Municipal Code is amended by
5adding Section 8-1-2.10 as follows:
 
6    (65 ILCS 5/8-1-2.10 new)
7    Sec. 8-1-2.10. Use of municipal funds for advertisements.
8No advertisement may be purchased using municipal funds that
9would include the name of any person holding an elected office.
10For purposes of this Section, "advertisement" means any type of
11announcement that is purchased for promotional purposes for
12print in a book, publication, brochure, sign, or digital media.
13"Advertisement" does not include a newsletter, publication, or
14digital media communication providing information pertaining
15to the community that is distributed to residents and
16businesses within the community, brochures or similar

1informational materials that announce or describe community
2events or activities such as conservation or recreational
3programs or festivals or other similar events. In addition,
4"advertisement" does not include a welcome sign, announcement,
5or digital communication announcing the entrance to a
6community, neighborhood, or a governmental facility or
7project.
8    A violation of this Section shall result in the person or
9persons who caused the municipal funds to be expended repaying
10the municipal funds used for the advertisement plus a $100
11assessment payable to the municipality. A second violation of
12this Section will result in the person or persons who caused
13the municipal funds to be expended repaying the municipal funds
14used for the advertisement plus a $250 assessment payable to
15the municipality. A third and any subsequent violations of this
16Section will result in the person or persons who caused the
17municipal funds to be expended repaying the municipal funds
18used for the advertisement plus a $500 assessment payable to
19the municipality.".
