AMENDMENT TO HOUSE BILL 229

2    AMENDMENT NO. ______. Amend House Bill 229 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by changing
5Sections 5-44010 and 5-44020 and by adding Section 5-44060 as
6follows:
 
7    (55 ILCS 5/5-44010)
8    Sec. 5-44010. Applicability. The powers and authorities
9provided by this Division 5-44 apply to McHenry County, Lake
10County, and DuPage County only to counties with a population of
11more than 900,000 and less than 3,000,000 that are contiguous
12to a county with a population of more than 3,000,000 and units
13of local government within such counties.

1    Sec. 5-44020. Definitions. In this Division 5-44:
2    "Fire protection jurisdiction" means a fire protection
3district, municipal fire department, or service organized
4under Section 5-1056.1 of the Counties Code, Sections 195 and
5200 of the Township Code, Section 10-2.1 of the Illinois
6Municipal Code, or the Illinois Fire Protection District Act.
7    "Governing board" means the individual or individuals who
8constitute the corporate authorities of a unit of local
9government.
10    "Unit of local government" or "unit" means any unit of
11local government located entirely within one county, to which
12the county board chairman or county executive directly appoints
13a majority of its governing board with the advice and consent
14of the county board, but shall not include a fire protection
15district that directly employs any regular full-time
16employees, a conservation district organized under the
17Conservation District Act, or a special district organized
18under the Water Commission Act of 1985.

21    Sec. 5-44060. Rights of former employees. On the effective
22date of dissolution, the employees of the former unit of local
23government shall be transferred to the governmental unit
24assuming the functions of the former unit of local government.

1bargaining representative shall not be affected by the
2consolidation or this amendatory Act of the 99th General
3Assembly. Obligations assumed by the government unit assuming
4the functions of the former governmental unit shall include the
5obligation to honor existing representation rights under the
6Illinois Public Labor Relations Act and any existing collective
7bargaining agreements. The rights of employees under any
8existing pension, retirement, or annuity plan shall not be
9affected by the consolidation or this amendatory Act of the
1099th General Assembly.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
